Head of Competition Litigation & Antitrust Economics at Deutsche Bahn AG


Under the leadership of Dr. Tilman Makatsch, the Competition Litigation & Antitrust Economics department at Deutsche Bahn has become a pioneer and European leader in the private enforcement of antitrust claims. Since the department was created in 2013, the team has successfully recovered approx. 500 Million EUR in claims for damages suffered through violations of antitrust law in more than 40 settlements. Prominent cases include the rail track, escalator/elevator and coffee cartels in Germany as well as the carbon brushes cartel and MasterCard in the UK. Further claims for damages totaling over 1 Billion EUR are being actively pursued in 6 different jurisdictions. The success of the department is, in part, based on the inter-disciplinary/international make-up of a team consisting of antitrust lawyers, litigators and competition economists skillfully selected by Tilman Makatsch.  The team has also been able to generate additional revenue for DB in successfully pursuing its damages claims together with affected third parties. For example, DB’s pursuit of damages in the truck and global air freight cartels. Recent awards for the Competition Litigation & Antitrust Economics department include, inter alia, the Juve “Inhouse Team of the Year” award, the GCR “Litigation of the Year” award, and the ILO/ACC “European Counsel Award – Competition” award. Tilman Makatsch was also nominated in 2018 as “Corporate Counsel of the Year” at the global GCR Awards.
