Nkululeko Christopher NdzenguRegional Head, Asset Forfeiture Unit at National Prosecution Authority (South Africa)
The AFU, in the National Prosecution Authority of SA (NPA), implements both criminal and civil asset forfeiture law contained in the Prevention of Organised Crime Act 121 of 1998 (POCA), making use of Motion Proceedings. It targets both proceeds of unlawful activities and instruments used in crime, the proceeds of which are deposited into a fund (CARA) used to bolster law enforcement and/or pay victims of underlying crime thereby following the notion that crime does not pay.
