The Latest Developments in the Pharma Sector

The European Commission is continuing to place heavy fines on pharmaceutical companies which breach EU competition law. One such example is the recent pay for delay Servier decision; the Commission imposed fines totalling €427.7 million on the pharmaceutical company Servier and five generic companies.
Keeping up to date with the latest case law and policy decisions is essential to ensure that you do not fall foul of the rules, which may result in substantial fines.
With this in mind, we have created a dedicated event for the Competition Law in the Pharmaceutical Sector where you can hear key developments from within the sector. Highlights include panel sessions on:
Practical Challenges in Patent Settlements
This panel session will cover the current practical challenges facing the pharmaceutical sector, legitimate settlements vs “pay for delay”, recent transatlantic developments and follow on damages and patent settlements. Our eminent speakers will also answer the question “to what extent do European authorities take transatlantic developments into account?” and analyse the implications of the Hauwei judgement for the pharmaceutical sector.
Current Developments in Abuse of Dominance
During this discussion experts will provide a review of recent IP case law including: the Pfizer and Aspen cases, new forms of abuse after the AstraZeneca case, how to asses dominance and ensure compliance as well as generic denigration. This will be covered alongside practical guidance on filling and prosecuting IP cases.
Current Enforcement Trends sessions
During the final panel session of the day, representatives from the national competition authorities and OECD will review current enforcement trends both across and outside of Europe as well as discuss regulatory solutions and market vaccines in Italy.
The event will be attended by in-house counsel from the pharmaceutical sector, representatives of national competition authorities and European Commission officials, so delegates will have an opportunity to ask the speakers their burning questions and network with their peers.
