James Weingarten is an antitrust trial lawyer and Partner in Milbank’s global competition group. Before joining Milbank in June 2024, he was Chief Trial Counsel for the Federal Trade Commission’s Bureau of Competition. In that role, he first-chaired and led trial teams in both merger and conduct matters, supervised the Bureau’s litigation group, and advised senior FTC leadership on litigation strategy. Before joining the litigation group, he worked in the FTC’s Health Care group. In the pharmaceutical sector, his experience includes litigating the Sanofi/Maze transaction and trying In re Impax Laboratories, Inc.; FTC v. Vyera Pharmaceuticals & Martin Shkreli; and FTC v. AbbVie, Inc.. Before joining the FTC, James was a trial lawyer in private practice, where he was part of the winning trial team in In re Nexium, the first reverse-payment case to go to verdict after the Supreme Court’s Actavis decision.
