Saami Zain is an Assistant Attorney General in the Antitrust Bureau of the New York Attorney General’s Office, where he has been involved in numerous merger reviews, investigations, litigations, as well as amicus filings in various industries including telecommunications, healthcare/pharmaceuticals, retail, travel/transportation, and technology.
Saami has particular experience in pharmaceutical antitrust, an area where he has published several articles and been involved in (and led) various investigations and litigations challenging anticompetitive conduct by pharmaceutical companies, in particular, State of New York v. Actavis, 787 F.3d 638 (2d. Cir.2015), where New York obtained a preliminary injunction preventing a large pharmaceutical company from effectuating a “hard switch” to force Alzheimer’s patients to use a newer, patented formulation prior to generic entry of the older formulation; FTC et al v. Shkreli, 571 F.Supp.3d 579 (S.D.N.Y Jan 14, 2022), aff’d 2024 WL 1026010 (2d.Cir. Jan 23, 2024), enjoining, banning and requiring disgorgement under New York law of the former CEO of a pharmaceutical company for anticompetitive conduct that impeded and delayed generic competition; and In the Matter of Emergent BioSolutions, Inc. (Dec. 2019), where New York negotiated the end of certain restrictions that impeded the supply and development of a nasal nalmefene devices for the emergency treatment of opioid overdoses. Saami received a J.D. from the University of Arizona and an L.L.M in Trade Regulation (Concentration: Antitrust) from NYU.
