Meena Datta, co-leader of Sidley’s Healthcare practice and member of its Global Life Sciences team, advises pharmaceutical, biotechnology, and medical technology companies on market access, pricing, reimbursement, and government price reporting matters. Her practice focuses on helping clients navigate the legal, regulatory, and commercial implications of federal and state drug pricing programs, including Medicaid Best Price (BP) and Average Manufacturer Price (AMP), Medicare Part B and Part D, 340B, VA/FSS and other government contracting requirements, as well as emerging Most Favored Nation (MFN) and international reference pricing proposals. Meena also has significant experience helping clients respond to controversial regulatory developments through coordinated litigation and advocacy strategies. She has advised on challenges to federal pricing and reimbursement initiatives, including advising on challenges to the MFN reference pricing regulation at issue in Cal. Life Scis. Ass’n v. Ctr. for Medicare & Medicaid Servs., No. 20-CV-08603-VC, 2020 WL 7696050, at *2 (N.D. Cal. Dec. 28, 2020). Meena counsels companies on contracting strategies, value-based arrangements, patient access and support programs, payer and channel relationships, and compliance frameworks that align pricing and market access objectives with evolving government pricing obligations and enforcement expectations.
