David B. Schwartz is an attorney in the Bureau of Competition’s Healthcare Division at the Federal Trade Commission, where he investigates and litigates healthcare antitrust conduct matters such as reverse settlement payment agreements, exclusive dealing, and anticompetitive acquisitions. David specializes in applying antitrust law in complex environments, such as when he led the majority of the FTC v. Surescripts investigation and litigation, including arguing against and successfully defeating the defendant’s motion to dismiss. David most recently argued in opposition to private equity defendants’ motion to dismiss in FTC v. United States Anesthesiology Partners. Before that, David concluded a detail to what is now the FTC’s Anti-Competitive Practices II division, where he led the investigation that resulted in the September 2023 FTC v. Amazon litigation. David previously spent several years in private practice, primarily representing another federal agency in bringing the first claims against major banks after the Great Recession.
David earned a J.D. from Stanford Law School and a B.A. in International Politics and Economics from Middlebury College. He was also a clerk for Judge Sandra Ikuta on the Court of Appeals for the Ninth Circuit.
