Simon has extensive experience in construction and construction supervision spanning his entire career, including having been the FIDIC Engineer on some 30 international contracts, and is viewed as an expert on the role of the Engineer under the FIDIC Conditions. He is particularly familiar with and has substantial experience in all aspects of claims and disputes (including avoidance, negotiation and settlement) under the FIDIC ‘Construction’ and ‘Plant & Design-Build’ 1999 editions of the Conditions of Contract. He advises both Contractors and Employers on claim, dispute, adjudication and arbitration matters, as well as advising Consulting Engineers on Contract Administration best practice. He is retained by UNOPS as a contract management advisor and is involved in numerous projects globally with them. It has often been commented that “he brings a refreshing touch of realism and practicality” and “is skilled at resolving disputes efficiently”. He is also an adjudicator.
A University Degree qualified UK Chartered Engineer with 30 years of professional experience, of which the last 25 years have been entirely in the international arena, working for Consultant, Client and Contractor organizations as well as directly for International Financing Institutions such as EU, EBRD, IDB, CDB, KfW, AfDB, ADB and JICA. In the past he held the positions of Vice President, Regional Director, Project Director, and Project Manager in the planning, procurement, design, tendering, construction supervision and management of FIDIC (and other) Contracts for water supply, sewerage and wastewater treatment, marine, highway and structural work in the UK and internationally. He is currently Managing Director of EIA Ltd, a UK company founded in 2000.
He has worked in various capacities in some 30 countries in Africa, Asia, the Caribbean, Europe and the ‘Near’ and Middle East, and predominantly on projects funded by the EU, EBRD, KfW, CDB, IDB, AfDB, JICA, World Bank and ADB.
He was the Task Group Leader of the FIDIC Updates Task Group (TG6B) preparing the 2nd Edition of the FIDIC Conditions of Contract for Construction (‘Red’ Book) and Conditions of Contract for EPC/Turnkey Projects (‘Silver’ Book) published in December 2017. He is also a member of the FIDIC Task Group TG9, preparing the new ‘Conditions of Sub-Contract for Design and Build’.
Simon has been a presenter at the residential Construction Law Summer School held at Cambridge University, UK since 2012 and he is a regular speaker on behalf of FIDIC at FIDIC International Users’ Conferences worldwide on a variety of subjects such as ‘The 1999 Conditions of Contract for Design & Plant Build’ and ‘The Role of the Engineer’. As well as a practicing professional ‘at the sharp end’, Simon is a FIDIC-accredited trainer, accredited to present FIDIC Modules 1, 1A, 2, 2A, 3, 4, 8 & 9.
