Karnan is a Partner with the international law firm Kennedys and the head of its sanctions team in Asia.
Karnan specialises in working with clients in the commodities, shipping and marine insurance sectors on complex disputes (often multi-jurisdictional and in international arbitrations) as well as on sanctions, export controls and other related regulatory matters. Having worked in Asia for over 20 years with clients in these sectors, he has extensive practical experience handling matters involving jurisdictions across the region.
He has particular expertise assisting clients in these sectors with all aspects of sanctions compliance including, drawing up and advising on sanctions compliance procedures, sanctions risk evaluation / mitigation for specific transactions, sanctions clauses and exit strategies, handling disputes arising from sanctions, applications for licenses / approvals in relation to potentially sanctioned transactions.
Karnan’s recent experience includes: acting for client shipowners in a related arbitration proceedings where the disputes had arisen from the carriage of a oil cargo from Malaysia (following a ship to ship transfer) but suspected to be of Iranian origin; advising charters and sellers of an oil cargo on sanctions issues arising from one of the parties’ involved in the transaction being placed on a sanctions list mid-voyage; advising a P&I insurer in relation to investigations by regulators where an assured had been involved in ship to ship transfers of oil that was suspected to have been delivered to North Korea.
