Recognition – insolvency, arbitration and court orders
At the outset of any dispute, a key question is where the defendants assets are and how they will eventually be enforced against. In cross border cases, the question of recognition is critical and often complicated. This panel compares the mechanics of recognition for insolvency processes, arbitration awards and court orders, and in this context focuses on systems that have different types of courts.
Fraud in high value family disputes
Increasingly, family disputes for ultra high net worth individuals are cross border: from disputes between heirs of estates that are litigated across multiple jurisdictions where the deceased testator held offshore trusts and onshore assets, to cross border asset recovery cases to enforce divorce settlements. This panel considers the challenges involved in these cases, the role of funders and receivers, and how clients can best be positioned for settlement.

Red flags for fraud, or cultural differences?
Conventional fraud prevention, anti-corruption and solvency thinking is often based on jurisdictions with long established business practices and developed regulatory regimes. But in evolving economies, or indeed new markets such as crypto assets, conventional wisdom often has little application. Our panellists discuss how to spot red flags in rapidly growing economies or sectors, and how to distinguish anomalies that are simply due to local business or industry practice, from those that are a sign of fraud or insolvency.
High value bankruptcies
This panel discusses high value personal bankruptcies – how do they differ from corporate insolvencies, legally and practically? What are the challenges in dealing with individual bankrupts, and how can insolvency practitioners deal with these?
