Aaron Jackson is the Loan Enforcement Team Leader of the firm’s Financial Services Litigation practice group. Aaron's practice focuses on working out distressed commercial loans, with an emphasis on representing holders and servicers of commercial mortgage-backed securities (“CMBS”) debt. Banks, loan servicers, life insurance companies, and private equity firms nationwide rely on Aaron’s experience to protect and preserve their collateral, enforce their rights as creditors, and maximize their recovery.
Having served in the firm’s Financial Services Litigation practice group since before the Great Recession, Aaron has worked out billions of dollars’ worth of distressed commercial debt by:
- litigating and collecting on promissory notes and guaranties;
- foreclosing on hotels, office buildings, shopping centers, apartment complexes and other types of commercial real estate;
- obtaining receiver appointments to protect and preserve collateral;
- negotiating and closing forbearances, modifications, discounted payoffs and loan sales;
- defending lender liability claims asserted by borrowers and other servicers;
- orchestrating sales of collateral under the Uniform Commercial Code (“UCC”), with an emphasis on financing secured by ownership interests in companies that own and operate commercial real estate;
- advising loan servicers on their rights and duties under servicing agreements;
- navigating creditor-side disputes among loan participants and investors; and
- representing creditors in cases where the debtor has filed bankruptcy.
Aaron has a truly national practice. He has appeared in dozens of state and federal courts across the United States. He is also an experienced appellate practitioner, having won appeals before the Second District Appellate Court of Illinois, Minnesota Court of Appeals, and Kansas Court of Appeals.
Aaron knows from his experience as a Staff Sergeant in the Army that the successful performance of any mission requires creative and comprehensive planning, efficient and timely communication among team members and decisive action. These principles form the core of his law practice as well.
