Being a stakeholder within today’s Built Environment/Construction industry calls for commercial, contractual, and legal awareness. A part of this requisite awareness is an understanding of contractual liability and how it can be curtailed. After all, all commercial transactions carry a risk of liability; So the performance of a contract may give rise to claims for damages and other financial consequences on the basis of, amongst other things breach of contract and/or negligence.
